Policy On Temporary Leave with Pay for Faculty,
Personnel Policy, SIUE, II-12

Temporary leaves with pay may be allowed for several reasons, including but not limited to, illness of immediate family members and funeral leaves. Time used as temporary leave with pay shall not exceed two weeks (10 working days) during any fiscal year except for jury duty that exceeds two weeks, court actions, and military leave.
In accordance with the definitions appearing below, faculty members may receive permission for absence from regular duties for a period not exceeding two weeks, except for jury duty that exceeds two weeks, court actions, and military leave. Approval must be obtained as soon as possible from the faculty member's immediate supervisor for all requests for temporary leave under this policy, and provision shall be made for continuation of assigned work during the absence wherever possible. In the case of faculty members, the dean or immediate supervisor shall notify the Provost and Vice Chancellor for Academic Affairs that leave has been granted.
The following definitions shall apply to requests for temporary leave with pay:
Family Illness Leave - ill members of the employee's immediate family;
Funeral Leave - funeral of immediate members of the employee's family;
Immediate Family - the spouse, same sex domestic partner, child, parent, grandparent, brother, sister, and corresponding in-laws of the employees.
Jury Duty - a leave of absence without loss of pay will be granted for time actually spent on jury duty.
Court Actions
A faculty member who is summoned by subpoena to appear in a court action or other state or federal agency hearing or proceeding shall be permitted to be absent without loss of pay and without charge against any leave, provided he/she is not a paid witness. If payment other than travel expense is received for services as a witness, then such absence shall be charged against vacation leave, or the employee may be granted a leave of absence without pay if there is insufficient vacation leave to cover such absence.
Military Leave
A faculty member who is a member of any reserve component of the United States Armed Forces or any reserve component of the Illinois State Militia shall be granted leave for any period actively spent in such military service, including:
- Basic training;
- Special or advanced training, whether or not within the State, and whether or not voluntary;
- Annual Training;
- Temporary Active Duty.
During such leaves, a faculty member's seniority and other benefits shall continue to accrue.
During leaves for basic training and up to 60 calendar days for special or advanced training, if that faculty member's compensation for military activities is less than his or her compensation as an employee, he or she shall receive his or her regular compensation as an employee minus the amount of his or her base pay for military activities. The deduction of military pay from the salary of a faculty member will be reflected in the first payroll prepared after verification of the amount of the employee's military pay.
During leaves for annual training, a faculty member shall continue to receive his or her regular compensation.
A faculty member serving as a member of the National Guard (or other State military component) who is called to temporary active duty in case of civil disturbance or natural disaster declared to be an emergency by the Governor may receive a combined wage from the University and the military equal to but not exceeding the faculty member's straight time daily rate for work days absent. If the daily rate received for temporary active duty exceeds the daily rate of the faculty member from the University, a faculty member may elect to accept the higher rate in which case the employee shall receive no compensation from the University. The amount of compensation received for temporary active duty shall be reported to the University within thirty days after release from temporary active duty. Appropriate adjustment to offset the amount received shall be made on the next regular payroll or as soon as practical thereafter. Time used for temporary active duty shall not be deducted from the time allowed for regular military training periods in accordance with this section. Faculty members are entitled to the right of continued employment or reinstatement after performing military service as provided under federal and state law. The University will comply with the Military Leave of Absence Act, 129 Ill. Rev. Stat. 500 et seq., as amended.
